The contract between Polaris Design Studios and the client will be on the conditions set out herewith to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.

All material contained within this site is protected by copyright law. All content within this website is available to users and visitors for personal reference and information only. It is prohibited to reproduce in content or aspect of this website without prior written consent from the company.

We advise that the use of this website is at the visitors own risk. Polaris Design Studios does not warrant the content, accuracy or veracity of any material on the website or can it guarantee that this website is free from any faults, errors, viruses or any other data-corrupting or damaging material.

The links to websites out with the Polaris Design Studios website are not endorsed in any way whatsoever by the company. Polaris Design Studios will not be held responsible for the content of external sites.

Any development/design related work including websites and programming codes remain the property of Polaris Design Studios until all outstanding monies owed is paid in full as agreed at the outset.,

Polaris Design Studios will not take responsibility for any materials submitted by the client with regards to copyright infringement. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

If the client requests additional work to be carried out, this will be completed at the discretion of Polaris Design Studios. Where no additional charge is made for amendments to the original agreed brief, Polaris Design Studios will not accept responsibility in the event of errors or other malfunctions occurring. Any corrections which required to be carried out due to amendments being requested which did not form part of the original contract may be subject to being charged accordingly.

The client agrees to ensure that all materials which are required to complete the website to the agreed standard are produced and made available as soon as is reasonably practicable.  

Polaris Design Studios will not be held accountable for any costs, compensation or loss of earnings which may result if there is a failure to meet agreed deadlines.

Polaris Design Studios will not be held responsible or be liable for any costs in the event that the website is offline.

Polaris Design Studios asks that the client fully tests their product prior to sign off to agree that the product meets the required expectations. Should any faults occur following testing, the Company cannot be held responsible.

Polaris Design Studios will refuse to be involved in any way whatsoever with material which may be considered to be illegal, offensive or controversial. 

A 50% deposit is required from the client before work will commence on a project. All deposits and start-up costs are non-refundable due to the nature of the individualised service.

Clients will have a period of 28 days to settle their outstanding invoice in full. In the event that an invoice is outstanding beyond the 28 day without prior agreement with Polaris Design Studios, access to the website will be limited or denied until such times that the outstanding amount is paid in full.

Polaris Design Studios recommend that clients ensure they have sufficient copies of all the content within their website.

Search engine optimisation services are provided with no guarantee with regards to a specific placement of the website on search engines.

Polaris Design Studios can provide only expected/estimated completion dates. We accept no responsibility for any losses incurred in the event that a project is not completed within an expected/estimated time frame.  

Following completion of the website, Polaris Design Studios will not be held responsible for any changes, errors or other malfunctions that may arise once the site has been signed off as completed by the client. Polaris Design Studios may charge fees to resolve any issues relating to the website following agreed completion of the site.

Polaris Design Studios reserves the right to amend, update and revise any initial quotes which are supplied to the client.

The Company reserves the right to revise and amend an initial quote to a customer where needed.

To the maximum extent permitted by law the Company excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred) of any kind arising out of or in connection with any visitor's or user's access to, or use of the Website, or any material thereon, whether based in contract, tort or whether negligent or otherwise, even if the Company has been advised of the possibility of such damage.
